1. Acceptance of Terms
By using the services provided by GreenMove Pembroke Pines Towing, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of our services after any changes indicates your acceptance of the new terms.
2. Services Provided
GreenMove Pembroke Pines Towing provides towing and roadside assistance services including emergency towing, flatbed towing, long-distance towing, motorcycle towing, accident recovery and winching, junk car removal, heavy-duty towing, and roadside assistance. All services are subject to availability and may vary based on location, vehicle type, and specific circumstances. We make every effort to provide timely service but cannot guarantee specific arrival times due to factors beyond our control such as traffic, weather, and vehicle availability.
3. Payment Terms
Payment is due at the time services are rendered unless prior arrangements have been made. We accept cash, all major credit cards, and insurance claims. Prices are based on factors including distance, vehicle type, time of day, and service complexity. You will receive an estimate before service begins, and we will inform you of any changes to the quoted price before proceeding. Failure to pay for services may result in a lien being placed on your vehicle in accordance with Florida law.
4. Vehicle Storage and Release
If your vehicle is towed to our storage facility, daily storage fees will apply starting 24 hours after arrival. To retrieve your vehicle, you must provide valid identification, proof of ownership, and payment for all towing and storage fees. Vehicles left unclaimed for more than 30 days may be subject to disposal in accordance with Florida abandoned vehicle laws. We are not responsible for personal items left in towed vehicles. You should remove all valuables before your vehicle is towed when possible.
5. Liability and Insurance
GreenMove Pembroke Pines Towing carries full commercial liability insurance and operates in accordance with all Florida state regulations. While we take every precaution to protect your vehicle during towing and transport, we are not liable for pre-existing damage, mechanical failure, or damage resulting from conditions beyond our control. You are responsible for informing us of any special handling requirements for your vehicle before service begins. Our liability is limited to actual damages not to exceed the current market value of your vehicle.
6. Customer Responsibilities
You are responsible for providing accurate information about your vehicle location, make, model, and condition. You must disclose any modifications, damage, or mechanical issues that may affect towing. You agree to remain in a safe location while waiting for our arrival and to follow all instructions provided by our operators. If you or any passenger behaves in a threatening, abusive, or disruptive manner toward our staff, we reserve the right to refuse service and contact law enforcement.
7. Cancellations and No-Shows
If you need to cancel service after a tow truck has been dispatched, you may be charged a cancellation fee. If we arrive at your location and you are not present or your vehicle is not accessible, a trip charge may apply. We will make reasonable efforts to contact you before applying any cancellation or trip fees. Please notify us as soon as possible if your situation changes or if you no longer need service.
8. Limitation of Liability
To the fullest extent permitted by law, GreenMove Pembroke Pines Towing shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim shall not exceed the amount paid for the specific service that gave rise to the claim. Some states do not allow limitations on implied warranties or the exclusion of certain damages, so some of these limitations may not apply to you.
9. Dispute Resolution
Any disputes arising from these terms or the services we provide shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Broward County, Florida. You agree to waive any right to a jury trial or to participate in a class action lawsuit. This arbitration agreement does not prevent you from filing a complaint with applicable regulatory agencies.
10. Governing Law
These Terms of Service are governed by the laws of the State of Florida without regard to its conflict of law provisions. Any legal action or proceeding related to these terms shall be brought exclusively in the courts located in Broward County, Florida. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
